These Terms & Conditions (“Terms,” “Agreement”) constitute a legally binding agreement between Build By Science (“Company,” “we,” “our,” or “us”) and the individual or entity (“Client,” “you,” “your”) accessing or using our fitness services. By enrolling in, accessing, or participating in any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. SERVICES OFFERED
1.1 Build By Science provides online fitness coaching services including but not limited to:
- The Ultimate Transformation Programs:
- 45 Days Game Changer Program
- 3 Months Game Changer Evolution X
- 6 Months Transformation Program
- Group Fitness Classes (live and recorded)
- Educational Webinars and Workshops
- Nutritional Guidance and Meal Planning
- Personalized Training Programs
- Digital Content and Educational Materials
1.2 All services are delivered through digital platforms, online communications, and virtual sessions unless otherwise specified.
1.3 Service delivery methods may include but are not limited to video calls, mobile applications, email correspondence, digital content delivery, and online portals.
2. GENERAL DISCLAIMER & PROFESSIONAL LIMITATIONS
2.1 Professional Scope: We are certified fitness professionals and nutritional coaches, NOT licensed medical doctors, healthcare practitioners, physiotherapists, or registered dietitians.
2.2 Service Intent: Our services are designed for general fitness improvement, lifestyle enhancement, wellness guidance, and educational purposes only.
2.3 Not Medical Treatment: All recommendations, programs, and advice provided are based on fitness training principles and general nutritional guidance, and do NOT constitute medical diagnosis, treatment, or therapy.
2.4 Individual Results: Results vary significantly based on individual factors including but not limited to genetics, adherence to programs, pre-existing conditions, lifestyle factors, and personal effort.
2.5 No Guarantees: Except as specifically outlined in Section 7, we make no warranties or guarantees regarding specific outcomes, timeframes, or results.
3. ELIGIBILITY & HEALTH REQUIREMENTS
3.1 Age Requirements:
- Clients must be at least 16 years of age
- Clients under 18 years must provide written consent from parent or legal guardian
- Clients under 16 are not eligible for services
3.2 Health Disclosure Requirements:
- Clients MUST disclose ALL medical conditions, injuries, surgeries, medications, supplements, metabolic disorders, eating disorders, mental health conditions, and ongoing treatments
- Clients must inform us of any changes to health status during the program
- Failure to disclose health information releases the Company from all liability
3.3 Medical Clearance:
- Clients with ANY health conditions must obtain written medical clearance from a licensed physician before beginning services
- Clients over 40 years of age are strongly advised to obtain medical clearance
- Pregnancy, recent surgeries, heart conditions, diabetes, and other serious conditions require mandatory medical clearance
3.4 Contraindications:
- We reserve the right to refuse services to individuals with conditions we deem inappropriate for our programs
- Certain medical conditions may require specialized medical supervision that we cannot provide
4. ENROLLMENT & ACCEPTANCE
4.1 Application Process: Enrollment requires completion of health questionnaire, program selection, and payment processing.
4.2 Right to Refuse: We reserve the absolute right to refuse services to any individual without providing reasons.
4.3 Program Capacity: Services may have limited capacity, and enrollment may be subject to availability.
4.4 Waiting Lists: If programs are at capacity, clients may be placed on waiting lists with no guarantee of future enrollment.
5. PAYMENTS, FEES & BILLING
5.1 Payment Terms:
- All fees must be paid in full at enrollment OR according to approved installment plans
- Payment constitutes acceptance of these Terms
- All prices are in Indian Rupees (INR) unless otherwise specified
5.2 Installment Plans (EMI):
- Available for select programs at Company discretion
- First installment must be paid to secure enrollment
- Subsequent installments are MANDATORY and NON-NEGOTIABLE
- Installments must be paid on or before specified due dates
- Late payment fees of ₹500 apply for payments more than 7 days overdue
- Failure to pay installments will result in immediate service suspension
5.3 Payment Methods:
- UPI, Bank Transfer, Credit/Debit Cards, and other approved methods
- Payment processing fees, if any, are client’s responsibility
- International clients may incur additional banking charges
5.4 Price Changes:
- We reserve the right to modify pricing at any time
- Current clients’ pricing remains fixed for their enrolled program duration
- Renewal programs may be subject to updated pricing
5.5 Non-Payment Consequences:
- Services will be suspended immediately upon payment default
- Access to materials, sessions, and support will be revoked
- Legal action may be pursued for recovery of outstanding amounts
6. PROGRAM STRUCTURE & SESSION POLICIES
6.1 Program Duration:
- Programs run for specified durations (45 days, 3 months, 6 months)
- Start dates are determined by enrollment date or batch commencement
- Program timelines are fixed and cannot be extended due to client delays
6.2 Session Scheduling:
- Clients must schedule sessions through designated booking systems
- Session times are subject to trainer availability
- Advance booking is required and recommended
6.3 Session Freezing & Rescheduling:
- Maximum 15-20 sessions may be frozen per program (specific to program type)
- Freezing requests must be made at least 24 hours in advance
- Frozen sessions do NOT pause payment obligations
- Frozen sessions carry forward within the same program cycle only
- Emergency freezing (medical/family emergencies) requires documentation
6.4 Missed Sessions:
- Sessions missed without 24-hour notice are considered “used”
- No-show sessions cannot be rescheduled or refunded
- Excessive missed sessions (>20% of total) may result in program termination
- Make-up sessions are at trainer discretion and subject to availability
6.5 Session Limits:
- Each program includes specified number of sessions
- Additional sessions may be purchased at prevailing rates
- Session credits cannot be transferred between programs or clients
7. REFUNDS & RESULT GUARANTEE
7.1 General Refund Policy:
- All sales are FINAL
- NO REFUNDS except under specific Result Guarantee conditions
- Payment processing fees are non-refundable in all circumstances
7.2 Result Guarantee (Conditional):
- Results are guaranteed ONLY for clients who maintain 100% compliance with:
- All prescribed workouts and training sessions
- Complete nutritional guidelines and meal plans
- Regular check-ins and progress submissions
- Lifestyle recommendations and guidelines
- Communication and feedback requirements
7.3 Guarantee Claim Process:
- Claims must be submitted within 30 days of program completion
- Clients must provide comprehensive evidence of full compliance:
- Complete workout logs and video submissions
- Daily nutrition tracking records
- All required progress photos and measurements
- Attendance records for all scheduled sessions
- Communication logs and check-in submissions
- Independent verification of compliance may be required
7.4 Guarantee Exclusions:
- Guarantee is VOID if client:
- Misses more than 10% of scheduled sessions
- Fails to follow nutritional guidelines
- Skips check-ins or progress submissions
- Has undisclosed medical conditions affecting results
- Uses unauthorized supplements or medications
- Engages in conflicting fitness programs
7.5 Refund Processing:
- Approved refunds will be processed within 30-45 business days
- Refunds will be issued to original payment method
- Processing fees and transaction charges will be deducted
8. HEALTH, SAFETY & LIABILITY WAIVER
8.1 Inherent Risks Acknowledgment:
- Client acknowledges that physical exercise and fitness activities carry inherent risks including but not limited to:
- Muscle strains, sprains, and injuries
- Cardiovascular events
- Equipment-related injuries
- Aggravation of pre-existing conditions
- In extreme cases, permanent disability or death
8.2 Assumption of Risk:
- Client voluntarily assumes ALL risks associated with participation
- Client acknowledges they are participating at their own risk
- Client understands that no fitness program is without risk
8.3 Medical Responsibility:
- Client is solely responsible for determining their fitness for participation
- Client must obtain medical clearance when required
- Client must immediately report any discomfort, pain, or adverse reactions
- Client must stop exercising if they experience any concerning symptoms
8.4 Complete Liability Release:
- Client releases Build By Science, its owners, employees, contractors, trainers, and affiliates from ANY and ALL liability for:
- Injuries occurring during or after program participation
- Aggravation of pre-existing conditions
- Equipment failures or malfunctions
- Advice or recommendations provided
- Any direct, indirect, incidental, or consequential damages
8.5 Indemnification:
- Client agrees to indemnify and hold harmless the Company against any claims, lawsuits, or damages arising from their participation
8.6 Insurance Recommendation:
- Clients are advised to maintain adequate health and accident insurance
- The Company does not provide insurance coverage for participants
9. CLIENT RESPONSIBILITIES & CONDUCT
9.1 Information Accuracy:
- Provide complete and accurate personal, health, and contact information
- Immediately update the Company of any changes to health status
- Ensure all documentation and submissions are truthful
9.2 Program Compliance:
- Follow all program instructions and guidelines
- Maintain regular communication with assigned trainers
- Submit required progress reports and documentation
- Use proper form and technique as instructed
9.3 Equipment & Technology:
- Ensure stable internet connection for online sessions
- Provide adequate space and equipment for workouts
- Maintain video and audio capabilities for virtual sessions
- Technical issues on client side do not warrant session credits
9.4 Professional Conduct:
- Maintain respectful and professional communication
- Arrive punctually for scheduled sessions
- Come prepared for sessions (appropriate attire, equipment, etc.)
- Follow all safety guidelines and recommendations
10. CODE OF CONDUCT & HARASSMENT POLICY
10.1 Zero Tolerance Policy:
- Absolute zero tolerance for harassment, abuse, discrimination, or misconduct
- This applies to interactions with trainers, staff, and other participants
10.2 Prohibited Behavior:
- Sexual harassment or inappropriate advances
- Verbal, physical, or emotional abuse
- Discriminatory language or behavior
- Threatening or intimidating conduct
- Disruptive or disrespectful behavior
- Sharing inappropriate content during sessions
10.3 Consequences:
- Immediate termination of services without refund
- Permanent ban from all Company services
- Legal action if warranted
- Reporting to appropriate authorities when necessary
10.4 Reporting Mechanism:
- Clients may report misconduct to management
- All reports will be investigated promptly and confidentially
- Appropriate disciplinary action will be taken against staff if warranted
11. INTELLECTUAL PROPERTY RIGHTS
11.1 Ownership:
- All content, programs, materials, videos, documents, and methodologies are proprietary to Build By Science
- This includes but not limited to:
- Workout plans and training programs
- Nutritional guides and meal plans
- Educational materials and webinars
- Video content and demonstrations
- Assessment tools and tracking systems
- Branded methodologies and systems
11.2 Usage Rights:
- Clients receive limited, non-exclusive, non-transferable license to use materials for personal use only
- Materials may not be copied, shared, distributed, modified, or commercialized
- Screenshots, recordings, or reproduction of content is prohibited without written consent
11.3 Violations:
- Unauthorized use or distribution will result in immediate service termination
- Legal action may be pursued for intellectual property violations
- Damages and attorney fees may be sought
11.4 Client Content:
- Client grants Company right to use progress photos, testimonials, and success stories for marketing purposes
- Clients may opt-out of marketing use by written request
- Company respects client privacy and will use discretion in content usage
12. PRIVACY & DATA PROTECTION
12.1 Information Collection:
- We collect personal information necessary for service delivery
- Health information is collected for program customization and safety
- Usage data may be collected for service improvement
12.2 Data Usage:
- Information is used solely for service delivery and improvement
- Health information remains confidential and is not shared with third parties
- Marketing communications may be sent unless opted out
12.3 Data Security:
- Reasonable measures are taken to protect client data
- No system is completely secure; clients acknowledge this inherent risk
- Data breaches will be reported as required by applicable law
12.4 Data Retention:
- Client data is retained for service delivery and legal compliance
- Clients may request data deletion subject to legal and business requirements
13. CANCELLATION & TERMINATION
13.1 Client Cancellation:
- Clients may cancel services with written notice
- Cancellation does not entitle clients to refunds except under guarantee conditions
- All outstanding payments remain due upon cancellation
13.2 Company Termination Rights:
- We may terminate services immediately for:
- Non-payment or payment default
- Violation of Terms & Conditions
- Misconduct or harassment
- Providing false information
- Excessive missed sessions or non-compliance
- Any behavior deemed detrimental to Company interests
13.3 Effects of Termination:
- All access to services, materials, and support ceases immediately
- No refunds are provided for terminated services
- Client obligations survive termination (payment obligations, confidentiality, etc.)
14. FORCE MAJEURE & SERVICE INTERRUPTIONS
14.1 Uncontrollable Events:
- Company is not liable for service interruptions due to:
- Natural disasters or acts of God
- Government regulations or legal restrictions
- Internet or technology failures
- Pandemics or health emergencies
- Trainer illness or unavailability
- Technical platform failures
14.2 Service Adjustments:
- Services may be modified, suspended, or delivered through alternative methods
- Clients are not entitled to refunds for force majeure events
- Reasonable efforts will be made to maintain service continuity
15. DISPUTE RESOLUTION & GOVERNING LAW
15.1 Governing Law:
- These Terms are governed by the laws of India
- Indian courts have exclusive jurisdiction over disputes
15.2 Dispute Resolution Process:
- Initial disputes must be addressed through direct communication
- Mediation may be required before litigation
- Arbitration may be mandated for certain disputes
15.3 Limitation of Claims:
- Claims must be filed within one (1) year of the incident giving rise to the claim
- Class action lawsuits are prohibited
- Clients may only seek actual damages, not punitive or consequential damages
15.4 Legal Fees:
- Prevailing party in legal disputes may recover attorney fees and costs
16. MODIFICATION OF TERMS
16.1 Right to Modify:
- Build By Science reserves the absolute right to modify, update, amend, or replace these Terms & Conditions at any time without prior notice
16.2 Notification of Changes:
- Updated Terms will be posted on our website and digital platforms
- Clients will be notified via email, app notification, or other communication methods
- Notification constitutes adequate notice regardless of whether client reads the communication
16.3 Effective Date of Changes:
- Modifications become effective immediately upon posting unless otherwise specified
- Continued use of services after modifications constitutes acceptance of updated Terms
16.4 Client Options:
- If clients disagree with modifications, their sole remedy is to discontinue services
- No refunds will be provided for services discontinued due to Terms modifications
- Clients who continue using services after modifications are deemed to have accepted the changes
16.5 Version Control:
- Current version date will be displayed at the top of these Terms
- Previous versions are superseded and no longer valid
- Clients are responsible for reviewing Terms periodically
17. MISCELLANEOUS PROVISIONS
17.1 Entire Agreement:
- These Terms constitute the complete agreement between parties
- No oral modifications are valid
- Written amendments require Company approval
17.2 Severability:
- If any provision is deemed invalid, remaining provisions continue in full force
- Invalid provisions will be modified to be enforceable while maintaining original intent
17.3 Waiver:
- Company’s failure to enforce any provision does not waive future enforcement rights
- Waivers must be in writing to be valid
17.4 Assignment:
- Clients may not assign or transfer their rights under these Terms
- Company may assign these Terms without client consent
17.5 Survival:
- Provisions regarding liability, intellectual property, and dispute resolution survive termination
17.6 Communication:
- All notices must be in writing and sent to last known contact information
- Email constitutes adequate written notice
- Clients must maintain current contact information
18. EMERGENCY PROCEDURES & MEDICAL INCIDENTS
18.1 Emergency Response:
- In case of medical emergency during virtual sessions, client must immediately contact local emergency services
- Company trainers cannot provide emergency medical assistance through virtual platforms
- Client is responsible for having emergency contact information readily available
18.2 Incident Reporting:
- All injuries or medical incidents must be reported to Company within 24 hours
- Incident reports should include detailed description, circumstances, and any medical treatment sought
- Company may request medical documentation for incident records
18.3 Medical Referrals:
- Company may recommend clients seek medical attention when appropriate
- Such recommendations do not constitute medical diagnosis or treatment
- Clients are solely responsible for medical decisions and costs
ACKNOWLEDGMENT & AGREEMENT
By enrolling in Build By Science services, I acknowledge that:
- I have read and fully understand these Terms & Conditions
- I voluntarily agree to all provisions and accept all risks
- I understand the limitations of services provided
- I acknowledge the liability release and waiver
- I agree to comply with all policies and procedures
- I understand that these Terms may be modified at Company’s discretion
- I have disclosed all relevant health information accurately
- I assume full responsibility for my participation and outcomes

1.3 Delivery Timeline
- Immediate Access Services: Account activation, portal access, and initial materials are delivered within 2-4 hours of payment confirmation
- Program Materials: Complete program packages are delivered within 24 hours of enrollment confirmation
- Live Session Access: Scheduling and booking access is activated within 24-48 hours of payment processing
- Custom Plans: Personalized workout and nutrition plans are delivered within 2-3 business days after initial consultation
1.4 Delivery Confirmation
- Clients receive email confirmation with access credentials and instructions
- SMS notifications are sent for critical updates and session reminders

2. PHYSICAL PRODUCTS (If Applicable)

2.2 Physical Product Shipping

- Platform issues resolved within 24-48 hours
- Third-party platform dependencies (Zoom, WhatsApp, etc.) are client’s responsibility
4. DELIVERY ISSUES AND RESOLUTIONS
4.1 Digital Delivery Issues
- Access problems must be reported within 48 hours of enrollment
- Technical difficulties will be resolved at no additional cost
- Alternative delivery methods will be provided if primary channels fail
- Backup access options ensure continuous service availability
4.2 Physical Product Issues
- Damaged products must be reported within 48 hours of delivery with photo evidence
- Lost shipments will be investigated with courier partners and replaced if confirmed
- Wrong address delivery due to client error will incur reshipping charges
- Refused delivery or unavailability will result in return charges being applied to client
4.3 Resolution Timeline
- Digital access issues: Resolved within 4-6 hours during business hours
- Technical problems: Maximum 24-48 hours for complete resolution
- Physical product replacement: 7-10 business days from issue confirmation
- Account access restoration: Immediate to 2 hours maximum
5. MODIFICATION OF DELIVERY POLICIES

- Complete attendance (maximum 2 missed sessions allowed)

- Regular check-ins and communication compliance
- Follow all lifestyle and recovery recommendations
Claim Process:
- Claims must be submitted within 30 days of program completion
- Comprehensive documentation required:
- Complete workout attendance records
- Daily nutrition tracking logs (photos, meal logs)
- Progress photos (weekly submissions)
- Body measurement records
- Communication logs and check-in responses
- Independent verification of compliance may be conducted
- Burden of proof lies entirely with the client
Refund Amount:
- 50% refund if no measurable results despite 100% compliance
- Processing time: 30-45 business days after claim approval
- Processing fees and transaction charges will be deducted
2.2 Technical Failure Refund
- Service unavailability for more than 7 consecutive days due to platform issues
- Complete inability to deliver promised services due to technical failures
- Prorated refund based on unused service period
- Must be reported within 48 hours of issue occurrence
2.3 Medical Emergency Refund
- Serious medical condition preventing program participation (doctor’s certificate required)
- Hospitalization for more than 2 weeks during program period
- Pregnancy complications requiring bed rest (applicable to female clients)
- Maximum 30% refund of remaining program value
- Medical documentation mandatory for processing
3. NON-REFUNDABLE SCENARIOS
3.1 Client-Related Cancellations
- Change of mind or personal preference changes
- Lack of time or schedule conflicts
- Relocation or travel commitments
- Financial constraints after enrollment
- Dissatisfaction with program structure (information available pre-enrollment)
3.2 Non-Compliance Situations
- Missed sessions exceeding policy limits
- Poor adherence to nutrition or exercise guidelines
- Irregular check-ins or communication gaps
- Violation of terms and conditions
- Harassment or misconduct leading to termination
3.3 Partial Program Usage
- Any program usage (accessing materials, attending sessions, receiving consultations)
- Download of digital materials or resources
- Participation in group sessions or webinars
- Consultation with trainers or nutritionists
4. CANCELLATION PROCESS
4.1 Cancellation Request
- Must be submitted in writing via email to [support@buildbyscience.com]
- Include full name, contact details, program enrolled, and reason for cancellation
- Supporting documentation if claiming medical or technical reasons
- 48-hour processing time for cancellation acknowledgment
4.2 Account Deactivation
- Immediate loss of access to all services and materials
- No grace period for accessing downloaded materials after cancellation
- Group class access terminated immediately
- Community forum and support group removal
4.3 Outstanding Payments
- All pending installments remain due even after cancellation
- No waiver of outstanding payments regardless of cancellation reason
- Legal action may be pursued for unpaid amounts
- Collection charges will be added to outstanding amounts
5. REFUND PROCESSING
5.1 Processing Timeline
- Approved refunds: 30-45 business days from approval date
- Bank processing time: Additional 5-10 business days depending on bank
- International payments: Up to 60 business days for processing
- Processing delays during festivals or bank holidays are expected
5.2 Refund Methods
- Original payment method: Primary refund method
- Bank transfer: If original method is not available
- UPI/Digital wallets: For smaller amounts (under ₹5,000)
- Processing fees deducted from refund amount
5.3 Refund Calculations
- Pro-rated calculations based on unused service period
- Deduction of setup costs: ₹1,000 for program customization
- Transaction fees: 3-5% of refund amount
- Administrative charges: ₹500 for processing

7.2 Webinar Cancellations
- Free webinars: No refund applicable
